These rules are set out below:
Art. 122 Privacy Code (Information collected from the contractor or user)
- The storage of information in the terminal equipment of a contracting partner or user or access to information already stored shall only be permitted if the contracting partner or user has given his or her consent after having been informed in the simplified manner referred to in Article 13(3). This shall not preclude any technical storage or access to information already stored if the sole purpose is to carry out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contractor or user to provide that service. For the purposes of determining the simplified procedures referred to in the first sentence, the Guarantor shall also take into account the proposals made by the most representative associations at national level of consumers and economic categories involved, also with a view to ensuring the use of methodologies that ensure the effective awareness of the policyholder or user.

For the purposes of expressing the consent referred to in paragraph 1, specific configurations of computer programs or devices that are easy and clear for the policyholder or user to use may be used.
2-bis. Without prejudice to paragraph 1, the use of an electronic communications network to access information stored in the terminal equipment of a contractor or user, to store information or to monitor the user's operations shall be prohibited.
Article 22 EU Regulation cit. - Automated decision making concerning natural persons, including profiling
- The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him/her or significantly affects his/her person in a similar way.

Paragraph 1 shall not apply where the decision:
- is necessary for the conclusion or performance of a contract between the data subject and a controller;
- is authorized by Union law or the law of the Member State to which the controller is subject, which also specifies appropriate measures for the protection of the rights, freedoms and legitimate interests of the data subject;
- is based on the explicit consent of the data subject.
- In the cases referred to in points (a) and (c) of paragraph 2, the controller shall implement appropriate measures to protect the rights, freedoms and legitimate interests of the data subject, at least the right to obtain human intervention by the controller, to express his or her opinion and to contest the decision.
- Decisions referred to in paragraph 2 shall not be based on the special categories of personal data referred to in Article 9(1) unless Article 9(2)(a) or (g) applies and adequate measures are in place to protect the rights, freedoms and legitimate interests of the data subject.
